Objetivo general
Objetivo General Determinar un Plan Integrador o de Inclusión de los alumnos de ambas modalidades de cursado (presencial y a distancia) de la asignatura Derecho de Trabajo en la carrera de Abogacía en relación al tema la DISCRIMINACIÓN LABORAL.
Resumen
La discriminación es un flagelo que afecta a la sociedad. Es universal, no distingue clases sociales, ni niveles de educación, no es exclusiva de ningún ámbito. Es dañina e ilegítima sin importar a donde se dé. La discriminación es un virus que poco a poco va enquistándose cada vez más en nuestra sociedad. El derecho del trabajo y las relaciones de trabajo, no son la excepción, es un ámbito en el que la conducta discriminatoria se hace presente, y hasta la última reforma, no tenía un tratamiento expreso ni especial en la LCT. Hoy, nos encontramos con una reforma laboral que expresamente nos trae el tema de la discriminación en el nuevo Art. 245 bis. Esta inclusión que tal vez en una primera mirada nos haga festejar su inclusión, luego y al analizar el contenido del artículo, la redacción del mismo y al compararlo con la Ley 23.592, normativa con la que contábamos hasta la última reforma para analizar y proteger a las víctimas de despidos discriminatorios, nos coloca en una situación de incertidumbre. Entre otros aspectos nos encontramos con la falta de un concepto claro de que debemos entender por discriminación. Una anunciación de supuestos que parecería ser taxativa. La expresa alusión a la carga de la prueba sobre la persona que alega la discriminación, que sin nombrarla claramente alude al trabajador y en última instancia la cuantificación de la sanción y su tabulación por un lado y la prohibición de la reinstalación como sanción aplicable ante el acto discriminatorio. Todo esto trae consigo un sin número de interrogantes que ya han puesto en acción corrientes de tinta doctrinaria. En este trabajo, nos disponemos a tratar solo algunos de esos puntos, procurando en primer lugar conseguir un contexto normativo y luego un análisis de la norma y la jurisprudencia de la CSJN que nos permita conseguir una respuesta a estos interrogante. En este sentido, abordaremos en primer término, la conceptualización de la discriminación y el despido discriminatorio, en segundo término la prueba del hecho discriminatorio y finalmente la consecuencia indemnizatoria y sancionatoria del despido discriminatorio.

Discrimination is a scourge that affects society. It is universal, drawing no distinctions based on social class or education levels, and it is not exclusive to any particular sphere. It is harmful and illegitimate regardless of where it occurs. Discrimination is a virus that is gradually embedding itself deeper and deeper into our society. Labor law and employment relations are no exception; they constitute an arena where discriminatory conduct is present, and until the latest reform, it lacked express or specific treatment in the LCT (Labor Contract Law). Today, we find ourselves with a labor reform that explicitly introduces the issue of discrimination in the new Article 245 bis. Although at first glance this inclusion might lead us to celebrate its introduction, upon analyzing the content of the article, its wording, and comparing it with Law 23,592—the framework we relied on until the latest reform to analyze and protect victims of discriminatory dismissals—it places us in a state of uncertainty. Among other aspects, we encounter a lack of a clear concept regarding what we should understand by discrimination. It presents a list of scenarios that would appear to be exhaustive. There is an express allusion to the burden of proof falling upon the person alleging the discrimination, which, without naming them explicitly, clearly refers to the worker. Finally, it addresses the quantification of the penalty and its tabulation on one hand, and the prohibition of reinstatement as an applicable sanction for the discriminatory act on the other. All of this brings with it a myriad of questions that have already set streams of doctrinal ink in motion. In this paper, we intend to address only some of these points, seeking first to establish a regulatory context and then to conduct an analysis of the rule and the jurisprudence of the CSJN (Supreme Court of Justice of the Nation) that allows us to find answers to these questions. In this regard, we will first approach the conceptualization of discrimination and discriminatory dismissal; secondly, the proof of the discriminatory act; and finally, the compensatory and punitive consequences of discriminatory dismissal.
