UNA APROXIMACIÓN AL TRATAMIENTO JURISPRUDENCIAL DEL ROL DE LA MUJER GESTANTE EN GESTACIONES POR SUSTITUCIÓN

Analizar el tratamiento dispensado por la jurisprudencia cordobesa a la mujer gestante en los casos de gestación por sustitución resueltos tras la entrada en vigor del Código Civil y Comercial de la Nación.

El proyecto persigue analizar el tratamiento jurídico dado a la mujer gestante en las gestaciones por sustitución, en los distintos pronunciamientos dictados por el Poder Judicial de la Provincia de Córdoba a partir de la entrada en vigor del Código Civil y Comercial de la Nación. Para hacerlo, indaga, primero, en las distintas corrientes doctrinales que se han posicionado en relación con la mujer gestante. Tras esta aproximación sustantiva al objeto de investigación, pretende aplicar dicho conocimiento al análisis de los fundamentos jurídicos que subyacen en las decisiones judiciales, para desentrañar, entre otros asuntos, el nivel de protección dispensado, la perspectiva de género con la que se ha decidido la causa y, a nivel general, el rol activo o pasivo que se ha otorgado a la mujer gestante en relación con los demás actores de las gestaciones por sustitución.

The project seeks to analyze the legal treatment given to the pregnant woman in surrogate pregnancies, in the different cases issued by the Judiciary of the Province of Córdoba since the entry into force of the Civil and Commercial Code of the Nation. In order to do so, it first investigates the doctrinal positions in relation to the role of the gestational surrogate woman. After this substantive approach to the object of research, it intends to apply this knowledge to the analysis of the legal grounds underlying judicial decisions, in order to unravel, among other issues, the level of protection provided, the gender perspective with which the case has been decided and, in general, the active or passive role given to the pregnant woman in relation to the other actors in surrogate pregnancies.
