Reconstruir a partir de resoluciones judiciales de la justicia penal de Córdoba, durante el año 2024, criterios de aplicación de la Prisión Preventiva, para diseñar una herramienta de IA.

En una investigación anterior analizábamos sobre los conceptos de verdad y de prueba en el tratamiento de hechos del futuro y la forma en las que los jueces fundamentan sus decisiones en relación a la existencia de riesgo futuro. El proyecto actual, propone un estudio de campo, que centra el análisis en los argumentos que fundamentan las decisiones judiciales en relación al dictado de las prisiones preventivas y cómo a partir de aquellos puede construirse una herramienta de IA capaz de predecir decisiones futuras de los tribunales sobre casos similares. Para el relevamiento de datos hemos circunscrito al dictado de prisiones preventivas durante el año 2024 por el Poder Judicial de la Provincia de Córdoba. Para alcanzar el objetivo propuesto se analizarán exhaustivamente resoluciones judiciales a fin de identificar criterios y argumentos que influyen y fundamentan tales decisiones. A partir de los datos recopilados en esa etapa, los esfuerzos se centrarán en depurar la información, establecer los patrones de análisis para la construcción del modelo de IA que pueda predecir la probabilidad de dictado de prisiones preventivas. Advertimos que el problema planteado se presenta como complejo y multifacético, por lo que el enfoque adoptado será multidisciplinario integrando tanto la perspectiva jurídica, lectura y sistematización de resoluciones judiciales, como la tecnológica, procesamiento de información y creación de sistema predictivo de datos.

In a previous investigation, we analyzed the concepts of truth and evidence in the treatment of future events and how judges base their decisions on the existence of future risk. The current project proposes a field study, focusing its analysis on the arguments underlying judicial decisions regarding the issuance of pretrial detentions and how, based on these arguments, an AI tool capable of predicting future court decisions in similar cases can be built. For data collection, we have limited ourselves to the issuance of pretrial detentions during 2024 by the Judicial Branch of the Province of Córdoba. To achieve the proposed objective, judicial decisions will be exhaustively analyzed to identify the criteria and arguments that influence and support such decisions. Based on the data collected at this stage, efforts will focus on purifying the information and establishing analytical patterns for building an AI model that can predict the likelihood of pretrial detentions. We note that the problem presented is complex and multifaceted, so the approach adopted will be multidisciplinary, integrating both the legal perspective (reading and systematizing court rulings), as well as the technological perspective (information processing and creating a predictive data system).
